TERMS AND CONDITIONS TERMS AND CONDITIONS The Rules of the Prize Draw Competition 1. Introduction 1.1 The Win Your Dream Bike Prize Draw Competition (“the Prize Draw Competition”) will be operated by the Promoter as a free draw with a paid entry route to which these Rules apply. 1.2 By entering the Prize Competition, players agree to be bound by these rules. 2. Definitions 2.1 “Chance” The entry into the Prize Draw Competition 2.2 “Closing Date” As defined by the Promoter and is displayed on the Prize Draw Competition website from time to time. 2.3 “Draw” The process by which winners are selected. 2.4 “Opening Date” When the Prize Draw is officially opened and is displayed on the Prize Draw Competition website from time to time. 2.5 “Promoter”` Endurance Zone Limited 2.6 “Rules” The rules of the Prize Competition as set out below and amended from time to time. 3. Entry into the Prize Competition 3.1 By entering into the Prize Competition you agree to be bound by the Rules and any relevant regulations made thereunder from time to time. The Promoter shall not be liable for any loss or damage (including loss of the opportunity to enter the Prize Competition and / or the right to receive a prize) suffered by you if you have not complied with the Rules. The promoter reserves the right to close the account of any person (paid or free) who is abusive or writes untrue or misleading information about the Promoter in the public domain. 3.2 The Rules may be amended by the Promoter from time to time. The current version of the Rules will be available on the Prize Draw Competition website. 3.3 Any entries received before the Opening Date and after the Closing Date of the Prize Draw Competition will be invalid and will not be entered into the Prize Draw Competition. 3.4 The Prize Draw is open for entry to all persons aged 18 and over excluding the Promoter, their employees, or anyone else connected with the development or operation of the website or administration of the Prize Draw Competition in any way, shape or form. 3.5 A Chance shall be declared void (without any refund being given) if you engage in: (a) any form of fraud (actual or apparent); (b) fraudulent misrepresentation; (c) fraudulent concealment; (d) hacking or interference with the proper functioning of the website; or (e) amending, or unauthorised use of, any of the code that constitutes the website. f) A ticket(s) is ‘purchased’ for free due to an error on site, or error in discount code 3.6 Entry into the draw is considered within UK Law and in line with the Gambling Act 2005. 3.7 Entry into the draw is open to UK mainland only 4. Purchasing a Chance in the Prize Competition 4.1 You can enter the Prize Competition by the purchase of a ticket before the Closing Date. 4.2 The cost of a Chance into the Prize Draw Competition is £5 per entry 4.3 The Promoter reserves the right to introduce time limited promotion offers and discounted pricing from time to time. Any such pricing will not be available retrospectively. 4.4 You will be required to provide the following information: 4.4.1 Your name, 4.4.2 Address, 4.4.3. Telephone number 4.4.4 Email address 4.4.6 The number of Chances in the Prize Draw Competition you wish to purchase 4.5 The Promoter shall be entitled to take any steps necessary to verify the above information and to process your purchase. The Promoter may (in its absolute discretion) refuse to accept an application for an individual to enter the Prize Draw Competition. 4.6 It is your responsibility to ensure that the personal information you provide to us is accurate. 4.7 You may purchase up to one hundred valid Chances for each draw. 4.8 There is a limited number of Chances for each Prize Draw Competition. If all of the chances are sold prior to the Closing Date then the Prize Draw Competition will close 5. Free Entry method 5.1 If you wish to enter any of the Promoters prize competitions for free then you must send an unenclosed postcard or letter via First Class post stating: The competition you would like to enter, along with your details as follows; Name, Address, email, DOB, Contact phone number. And Post to: Win Your Dream Bike 7 Leightonhouse Close St Neots PE 19 6BW 5. 2 Only one postal entry per person per postcard or letter will be accepted. Bulk entries are not permitted. 5.3 All free entries must be received before the close of the competition, Any, entries that fail to follow the criteria mentioned above will be void as per any entry received. 5.4 Entrants must have an active account on the Promoter’s website at the time the free entries are processed, all details must match those on the account to which they are to be added. 5.5 The Promoter will check for all postal entries on closing of the draw. No liability is accepted for illegible, incomplete or late entries. 6. Payment 6.1 The purchase of a Chance can only be made via Debit Card via the Prize Draw Competition Website. 6.2 Debit Card payments will be referenced as Win Your Dream Bike on your card statement. 6.3 Entrants accept that entry in itself and payment of the £5 per entry fee (or less on promotional offers made from time to time) does not guarantee that they will win a prize. 6.4 Your paid Chances will not be entered into the Draw unless the Promoter has received all amounts payable (cleared funds) relating to your Chances by the published Closing Date of the Draw. If there is a dispute regarding whether Chances have been paid for then such dispute shall be decided by the Promoter. 6.5 Refunds will not be made on any payments made for the Prize Draw Competition. 7. Draws 7.1 The Draw date will be communicated on the website and on email confirmation receipt. 7.2 The Draw will be determined by means of an industry standard random number generator software as approved by and in accordance with the guidelines issued by the Gambling Commission. 7.3 When the Closing Date is reached, the Prize Draw Competition will close. 7.4 The nominated contacts at Endurance Zone responsible for facilitating the draw, along with their family and friends are not eligible for entry into the prize draw. 8. Prizes 8.1 The winning prize will be clearly displayed on the website. 8.2 The Promoter reserves the right to amend the prize at any time for equal value or similar specification. Any such changes will be published on the Prize Draw Competition website. 8.3 The results of the Draw will be published on the Prize Competition website or associated social media within one week of the date of the Draw and may also be published in any other manner determined by the Promoter from time to time. 8.4 Winners will be notified within one week of the date of the Draw. 8.5 The Winner will be required to forward a copy of identification to the Promoter to prove their identity and that their entry was made using a valid card. 8.6 The Promoter reserves the right to withhold any prize until it is entirely satisfied that the purchaser who has won the prize has fully complied with the Rules. 8.7 If the winner can not be contacted by the Promoter within 14 days of being notified of their status as a winner from contact details submitted in their entry, the Promotor shall be entitled to award the prize to the entrant selected by drawing another winning entry at random. 8.8 By accepting the prize, the winner can consent to take part in promotional activity. On consent, the Promoter reserves the right to use the name and address of the winner, their photograph and audio/or visual recordings of them in any publicity. 8.9 Any local or national tax liabilities in your country of residence arising from the awarding of the prize or any other costs incurred by the winner in relation to participating in the Prize Draw Competition shall be the solely responsibility of the winner. 8.10 All other expenses, not expressly specified herein are the sole responsibility of the winner. 8.11 The Promoter is not responsible or liable in any way for the valuation of the prize and makes no representation or warranty in respect of its accuracy. 8.12 The Promoter does not offer a cash alternative to any of the Prize Draw Competition prizes. 8.13 On receipt of the prize, the winner assumes ownership of the prize. It is not the responsibility of the promoter to resolve any issues regarding the prize once the prize has been received. 9. Suspension of the Prize Competition 9.1 The Promoter may (at its absolute discretion and only in exceptional circumstances) suspend the Prize Competition for any period of time. During such period, the Promoter shall retain any amounts which were paid until refunds are carried out. 9.2 You will be notified of further details regarding the resumption of the Prize Competition or otherwise as soon as reasonably practicable after the date of suspension in writing. 10. Liability 10.1 The Promoter shall not be liable to you for any loss or damage suffered by you arising from: 10.1.1 Any delays or failures in the postal service or other delivery methods used by The Promoter or you from time to time. 10.1.2 Any delays or failures in any systems used by the Promoter or you to transmit e-mails. 10.1.3 Any failure in any software or other systems used by the Promoter. for the administration of the Prize Draw Competition. 10.1.4 Any delays of failures in the banking system used by the Promoter. or you. 10.1.5 Any failure to enter your Chance into the Draw. 10.1.5 Any event beyond the reasonable control of the Promoter 10.2 The Promoter shall not be liable to you in contract, tort, negligence or otherwise for any indirect or consequential loss suffered by you in relation to your participation in the Prize Draw Competition (including loss of the opportunity to enter the Prize Competition and / or the chance of winning a prize). 10.3 The Promoter is not responsible or liable in any way for the use of or injury resulting from the use of any of the prizes from the Prize Draw Competition. 10.4 The Promoter is not responsible or liable for any issue relating to the condition of the prizes 11. Complaints 11.1 The Promoter’s decisions made pursuant to the Rules shall be final and binding. 11.2 Save where the Rules expressly provide otherwise, the Promoter shall not be obliged to enter into any correspondence. 11. Privacy 12.1 The Promoter is committed to protecting your privacy. Data that we collect from you is used lawfully in accordance with the General Data Protection Regulations 2018 and is used solely for the purpose of processing your purchase of Prize Draw Competition Chances, informing you of future Prize Draw Competitions, subsequent entry into future Prize Draw Competitions, and informing you if you have won a prize. 12.2 You have the right to access the information we hold about you. To obtain this information, please contact the Promoter. You will be asked to provide proof of your identity prior to personal information being disclosed to you. 12.3 The Promoter will not sell, rent or grant access to any of the personal data we collect about you to any third parties without your express prior permission. 12.4 We may share aggregated information to third parties. This will not contain personal information that can identify any individual person. 13. Proper Law and Jurisdiction 13.1 The Laws of England and Wales shall govern the interpretation and/or enforcement of these Rules and the Promoter and all entrants hereby submit to the exclusive jurisdiction of the English courts. 14.
